Before the court is the plaintiffst motion for permanent reliefflled october 22, 1985 and the defendantst response Lhereto filed
November 7, 1985. Plaintiffs request an order enjoining the defen-
dants to use the same election districts established by-the courtrsorder of October 30r 1984 for the years 1986 and thereifter pending
final resolution of this controversy. Defendants apparently-do
not oppose the motion.

At this time the case is pending on appeal in the Supreme Court.
Before taking further action on plaintiffs' pending motion the court
requests comment of counsel on the effect of the pendency of the
appeal on the courtrs jurisdiction to enter an order on plaintiffsr
motion at this time.

Prease let us have your responses on or before December l,
1985.
