Re: Gingles v. Edmisten

Dear Jim:

This letter is to confirm our telephone conversation of April
16, 1984. During Ehat conversation, I info::ured you Ehat Bill
Cu1p, the supervisor of eLections for Mecklenburg County, had
told me that he had interpreted an instruction from you Ehat
he is to accept candidate filing for the Mecklenburg County
House and Senate Districts begiining on April 23, 1934 ,
whether or not the Court has approved the distrieting pLan
which you have submitted.

It is my position that accepting candidate filing for districts
which have not been approved by the Court not only violates
paragraph 2 of the Court's January 27, 1984 Order but also
is contrary to Sections 2 and 3 of Chapter 2 of the Session
Laws of the 1984 Extra Session.

I hereby request that you instruct Mr. Cu1p, and the oEher
supervisors of elections of counties effected by the Court's
January 27, f984 Order, that they are not to accept candidate
filing on April 23, 1984 unl-ess the Court has issued an Order
approving the proposed districts and, for those counties in
former Senate District No. 2 and former House District No. 8,
unless the proposed districts have been precleared pursuant
to Section 5 of the Voting Rights Act.
