STIPULATION OF CLASS ACTION

Plaintiffs and defendants in the action of Ralph Gingles,

et a1. v. Rufus Edmisten, €t a1., No.81-803-CIV-5 agree that

it is in the best interest of all parties to this action for

the action to prcceed as a cLass action. The parti-es further

stipulate that the class of all black residents of the State of

North Carglina who are registered to vote is an aPPropriate class

which meets the prerequisite set out in RuIe 23G) and (b) (2) '

In addition, the parties to Gingles v. Edmisten do not object to

the exclusion of the black named plainEiffs in Eug.h, et al., v.

Hunt, €t aI., No. 8|-1066-CIV-5, from the class certified in

Gingles, et aI. v. Edmisten, et al.
