Dear Ms. Guinier:

r am writing as a foIlow up to our telephone conversatj-on
of today, September 28.

As I noted during that conversation, it appears unavoidable
that the deposition of Mr. Hortonrs computer expert in the case
of Cavanagh v. Brock, 82-545-crv-5, contlnue to be scheduled for
October 4,7982, and that the deposition start at 9:00 a.m. in
Mr. Horton's offices in Winston-Sa1em, North Caro1ina.

_ As you know, the logistics surrounding the holding of this
deposition have been somewhat difficult. i appreciate the fact
that, at present, it is doubtful that any plaintiffs' attorney
from the case of Gingl-es v. Edmisten, 8l--803-crv-5, wilr be abl-e
to be present tor onday. However, please rest
assured that I wil-l make avaj-Iabl-e to you a copy of the transcript
of said deposition as soon as it is prepared, per your request.

In any event, I hope your schedule changes so that you will
be able to be present j-n Winston-Sa1em on October 4.
