MOTION TO CONSOLIDATE
CoME NOhl the defendants in each of the above-entitled act'ions, and move the
court to order a complete consol'idatjon of the above-entitled act'ions, for all
purposes, pursuant to Rule 42(a) of the Federa'l Rules of Civil Procedure.
In support of the nrotion, and as grounds therefor, defendants state:
1. Each of the above ent'it'led actions challenges the apport'ionment plans for
the House of Representatives and Senate of the North Carol'ina General Assembly,
although pla'int'iffs John J. Cavanagh, et al ., have challenged only those portions
of the p'lans jnsofar as they pertain to Forsyth County.
2. Each action involves common questions of law and fact relating to.the enact-
ment of redistrict'ing plans for the North Carolina House and Senate in compliance
with the United States Constitution, the Voting Rights Act of 1965 (42 U.S.C. 51973)
and the North Carolina Const'itution. Relief, if any, granted to any of the p'laintiffs
relating to legislative apport'ionment must be consistent.
q. The defendants in each act'ion are essentially the same, although plaintiffs
John J, Cavanagh, et a1., have named only the Executive Director and members of
the North Carolina State Board of Elections as defendants, wtrile plaint'iffs Ralph
Gingles, et dl., and Alan V. Pugh, et al., have included as defendants addit'ional
State off icers acting in their off ic'ial capac'it'ies.
