Pursuant to motion concerning further proceedings filed by

the plaintiffs on September 10, 1985 and consented to by counsel

for the defendants it is now

ORDERED:

1. That the court's order and judgment of

January 27, 1984 be and the same is hereby vacated only insofar as

it concerns House District No.23, and plaintiffs'claims with regard

to House District No. 23 are dismissed wihout prejudice to plaintiffsl

ability to renew these claims in light of the circumstances of the

future operation of the at-large method of election in Durham

County or in light of other material changes in circumstances.

2. Plaintiffs and plaintiff-intervenors are

allowed to and including December l, 1986 in which to file a peti-

tion for award of attorneys'fees and costs in this action.
