The House legislative Redistricting Comnittee net at

10:50 B.rrr. on February 91 1982, in Room 1228 of the legis-

lative Building.

Representative Li11ey, Cochairmanr ca1Ied the roeeting

to orcler. A ro11 call wa-s taken, and all nernbers were present.

Representative l,i11ey read a paragraph taken frorn a l.etter

from tire U. S. Justice Department to the Executive Secretary

of the State Board of Elections in vrhich our reCistrlctir:g

plan was rejected.. He stated that it would give the Comniittee

some idea of the gUidelines under which they would need to

operate

Representative Li11ey introduced. Jim llallace and. Tiare B.

Smiley, attor:reys in the Attorney General-'s office. Repre-

sentative Li11ey then recognized Jim tJa11ace, who restated

the two essential considerations that confront the Coromitteet

namely (f) that it was incumbent on them to apply the fed.eral

constitutional. one person, one vote requirements set by the

U. S. Supreme Court in reading the 14th auendment, and

(2) to indicate their advertence to concentrations of ruinority

t6ters in the eovered counties of the state. He stated, that

who is an attorney with Jeuis Leonard's fi:m in Washington.

She spoke to the Committee and then answered a nurober of

questions.

Representative Li11ey then asked if there were any

amend.uents to Iiouse Bill 1 before them.

Representative Quinn was recognized. He read an amenC.-

ment affecting Districts 74 and ,, after which he answered

questions. Representative Lil1ey asked Bill llale, &n attorney

with the Legislative Servj-ces staff , vrhat the amend.ment did

I'ron the staldpoint of deviation. He was advised. that it was

r:rder 5% d.evt,ation. Representative QUinn moved that the anend-

uent be adopted. Representative Grady seconded the uotion.

Representative Alnond spoke against the notion after which

Representative li11ey asked. for any other discussion. There

being none, he asked for a vote on the amendment set forth by

Representative Quinn.

Representative Nash offered an amendment that affectecl

only Rowan County and. moved that it be adopted. Bill Hale

advised that the amendment did not affect the overall- range.

The motion was seconded by Representative Church. Follouing

a brief d.iscusSion, a vote vlas taken, the motion capied. A

copy of the amendment is attached.

A recess was called' at l-l:55 8.IIl.

rlhe neeting reconvened at D;25 p-m. at which tine Rep-

resentative llorgan offered an amend.ment and map that d.ealt

with Guilford County, ancl he uoved. for its adoption. The

motion r.ras secon$ecl by Representative Edwards. Mr. Gerry

Cohen ex-olained the amenCrnent further and stated. the district

relative deviations were all withtn ,%. There .being no dis-

cussion, a vote was taken, the notion carried. Cop:-es of the

Representative Gillan was recognizecl and made a motion

that House Bill 1 be given an unfavorable report. A vote

Motion failed.

Representative Taylor offered an amendment concerning

Districts 12 and 14 and moveil for its adoption. The amencl-

ment would stay within 5% relative deviation and have no

ad.verse affect on the minority vote in that area. There

tlas no discussion. A vote was taken, and the urotion carried.

Representative Spaulding stated. that amendments would

be made on the floor of the House Chambe::.

Representative Guy moved that House Bill 1r as amendedl

be given a favorable reportl seconded by Representative Bone..

Representative Ilege was recognized and made a substitute

notion that House Bill l-, as amended, be clisplaced and that

the single member redistricting plan submitted by hin last

week be adopted. Represent'ative Hightower maile a motion that

Representative llege's substitution motion do 1ie upon the tablet

which he subsiequently withdrew. A vote vras taken on Represen-

tative l{ege's substitute motion, ani the motion failed.

The original bill was then back before the Committee.
