I. Prelimina Re nse to Defendants' Submission

Plaintiffs respond to defendants' March 72, 1984, Motion and

Submission pursuant to the Courtrs Order and Judgment of January

27, 1984r ds follows:

A. Defendants have not demonstrated that they have completely

remedied the violati-ons of 52.

Having found defendants in violation of the mandate of 52 of
the voting Rights Act, of 1965r ds amended, 42 u.s.c. 51973, the

Court deferred further action to al1ow defendants an opportunity
to redistrict in compliance with 52 and "to assess the amended

statute's substantial new requirements for affirmatively avoiding
racial vote dilution rather than merely avoiding its intentional-
imposition." Mem. Op. at 70.

Defendants have the burden of demonstrating that their pro-
posed new districts adequately remedy the 52 violati_on found by

the court. This burden is required by the basic principles of
equity adopted by congress in amending 52. As the legislative
history makes clear, the relief should be fashioned so that "it



completely remedies the prior dilution of minority voting strength
and fu11y provides equal opportunities for minority citizens to
participate and to elect candidates of their choice. " senate

Report at 31. Defendants' Motj-on for approval of their substitute
plan must, therefore, be denied unless and until defendants demon-

strate that those plans completely remedy the violation found by

the Court and fu11y provide bl-ack voters in North Carolina an equal

opportunity to participate and to elect candidates of their choice.

Defendants have not demonstrated the absence of discrimi-
natory purpose and result in the proposed districts.

Plaintiffs preliminary examination of defendants' submission

reveals that defendants have failed to meet their obligation at
the remedial stage of this lawsuit. Examples are as follows:

(1) Defendants failed to demonstrate that they avoided dilution
of minority voting strength in districts which do not have effective
black voting majorities but do have recognizable and substantial
concentrations of black voters. These include in particular House

District No. 8, a three member distrj-ct composed of parts of
wilson, Edgecombe and Nash counties, and House Districts 36 and

54-60, which district Mecklenburg County.

(2) Defendants have failed to demonstrate the absence of
discrj-minatory purpose and discriminatory result in their combina-

tion of multi-member and sj-ngle-member districts, particularly in
the division of former House District No. B (wi1son, Edgecombe

and Nash counties) into proposed House Districts Nos. B and 70.

Defendants have further failed to show the absence of discriminatory
purpose and result in the contorted configuration of the Mecklenburg

county House Districts (Nos. 36 and 54-60). These districts
severely fracture communities of interest and are so irregularly
shaped that voters will not be able to learn in which district
they live in order to use their votes effectively.

(3) Defendants have failed to demonstrate that the plans

they submitted are based on any rational or objective criteria
other than the need to protect white incumbents.

Because of the deficiencies noted above, plaintiffs are

particularly concerned about defendants' failure to completely

remedy the violations of 52 in the redistricting of former House

Districts Nos. 8 and 36. Plaintiffsr preliminary examination

does not reveal substantial problems in proposed House Districts
Nos. 2L and 55-61 (Wake County), 23, 68-69 (Durham County), or

39, 66 and 67 (Forsyth County) , or in proposed Senate Districts
l, 2, 6, 9, 10, 11 and L4 (Northeast Senate Districts), or 22 and

33-35 (Mecklenburq and Cabarrus Counties).

II. Motion for Leave to Take Depositions

rn order to be able adequately to present to the court evi-
dence of the failure of proposed House Districts, particularly
Nos. 8,70,36, and 54-60, to remedy the violations found by the

Court, plaintiffs reguest leave to take the depositions of legisla-
tors and legislative staff members directly involved in developing

those districting proposals. Plaintiffs further request leave to
take depositions in lieu of testimony of witnesses who live outside
the subpoena jurisdiction of the court pursuant to Rul-e 45 (e) (1),

F. R. Civ. P.

III. Request for Evidentiary Hearing

Pursuant to Rule 43 (e) , F.R.Civ.p., plaintiffs request

that the Court schedule defendants' Motion for an Evidentiary
Hearing, to be heard on oral testimony and deposition, to
provide the court and plaintiffs an opportunity to assess the

adequacy of defendants' proposed remedy. plaintiffs further
request that the Court set a schedule for briefing of this Motion.

IV. The Court Should Order Complete Relief.
In the event that the Court concludes on the current

record that the plans submitted by defendants to not completly

remedy the viorations of 52, plaintiffs request that the court
order defendants to hold elections in former House District No. 8

i-n accordance with Exhibit 93 (H400 N54) and in former House

District No. 36 in accordance with Exhibj-t 94 lH4O0 N75) or Exhibit
9s (H400 N90 ) .

Each of these proposals was submitted to the North Carolina
General Assembry in the House Redistricting committee and on

the floor of the House of Representatives but was rejected.
Plaintiffs submit that each of these plans would completely

remedy the 52 vioJations found by the court and would provide

brack voters in these districts an equal opportunity to partici-
pate in the poritical process and to elect representatives of
their choice.
