Reapportionment Suit
Dear Gentlemen and Leslie:
I met with the Department of Justice on August 26 and obtained
a copy of the encloded submission by North Carolina and the
objections which have been filed. I do not have the Republican
objection. It is being mailed to me.
I understand that Justice will ask for mcre information.
I indicated, however, that we would be filing objections on
behalf of our clients shortly and would indicate that we are
putting together some additional supporting data. Even if
Justice asks for additional information, I think we should
get our objections on fi1e.
You may or may not know that the thrce-judge court in Virginia
declared the reapportionmenL of Virginia unconstitutional.
The decision is based on the one-man, one-vote issue and since

variances in North Carolina are at least equal to the variances
declared unconstitutional in Virginia, we should have a good
chance with respect to this issue. For relief purposes, however,
we need to file the suit as soon as possible. Please let us
have your cornrnents about Leslie's latest draft complaint.
I understand that Steve is preparing the draft objection letter.
InIe need to file the objections before September L4 and indicate
that additional supporting data will be submitted.
I have spoken with Eddie Williams and with Armand Derfner.
Armand is Erying to identify a historian for us. He has indicated
that the Joint Center may be able to assist financially in covering
the cost for the study. I am to meet with Armand again in the
near future and will advise.
The Lawyers' Conrnittee has expressed an interest in the case.
I have forwarded a copy of the draft complaint to them.
The Lawyers' Conrnittee has the experience from the Virginia
case and may be of help to us.
