Dear Julius and Leslie:
Enclosed is the Senate Report on the new Voting
Rights Act. It contains a good deal of materiits
on the meaning of the "results" or "effects" test.
The law firm of Davis, polk a Wardwll has agreed.
to give me by July L9, lg82 a first draft of a
memorand.um on the legislati-ve history of amended
Section 2 with its I'results,, test and a memorandum
on the constitutionality of the new standard. I
will forward to you the reports as they come in.
It may be that we will also need a memorandum on
the application of the new standard in the reappor-
tionment context, in general, and. in the context
of the Gingles case, in particular.
Jack has suggested the advisability of a general
conference to talk about the implication of the
new Voting Rights Act. I would like to know your
comments on this
I will call Leslie soon to be brought up to d.ate
on the Gingles case as well as apoligize for not
returning immediately her phone ca1l. I should
also like to repeat my repeated requests for the
depositions or copies of them. Lani and. I talked,
before the last depositd.ons taken about the nature
and scope of the questions to be asked., but iL may
be that we will have to reconsider that issue in
light of the extension and modification of the
Voting Rights Act and the d.emands of the 1awsuit.
