Dear lv1s. Guinier :
The Washington Legal Foundation ("WLF"), a non-profit public
interest law center based in Washington, D.C., is planning to file
a brief amicus curiae supporting the appellants in the referenced
case. In accordance with Supreme Court Rule 36, we hereby request
the appellees' consent to the filing of wLF's brief.
In essence, WLFrs brief will argue that the district court
erred in treating Section 2 of the Voting Rights Act as though it'
compels the fashioning of districts which, wherever possible, will
allow bloc voting by minorities to control the outcome of
elections. wLF,; brief wilI also argue that the district court
erred in finding that the North Carolina districts were
characterized bi u legalIy fatal degree of "polarized voting".
Counsel for the appellants have already indicated their
consent to the filing of WLF's brief. If you agree to consent to
the filing of our brief, would you please send a brief note to
that effeit so that, in compliance with RuIe 36, we can file
without seeking leave of Court.
