Now into court come counsel for Ronald Chisom, et al, 

plaintiffs-appellees, who respectfully request that the expedited 

appeal of the preliminary injunction granted by the District 

Court be heard by the original panel which heard this matter• the 

last time it was before this court, for the following reasons: 

1. A three judge panel already decided the underlying legal 

issues in this matter when the case was decided earlier this year 

in Chisom v Edwards, 839 F. 2d 1056 (5th cir. 1988). 

2. Plaintiffs-appellees already requested that this 

original panel grant injunctive relief, provided supporting 

affidavits, and briefed the issue for the original panel. The 

original panel issued a per curiam decision on May 27, 1988 after 

reviewing these factual and legal submissions so they are 

familiar with the essential elements of this action. 

For these reasons it is requested that this matter be 

assigned to the original hearing panel.
