Wllllam Kenneth Hale, being duly sworn, deposes and says:

1. I am an attorney licensed ln the State of North Carolina and am

employed by the North Carolina General Assembly. I served as chlef

counsel to the House LegisJ-atlve Redistrictlng Conrnittee (hereinafter

the Conrmlttee) for the 1981 General Assembly.

On January 28, L982, the Corrnlttee adopted a set of criteria, based

on federal and State redistrlcting requlrements, to gulde it in

creating representative dlstricts for the North Caro1l-na General

Assembly. (A copy of these criteria is attached hereto as Hale

Affidavit /12 Exhibit A'and ts hereby incorporated by reference as if

fu1ly set forth herein.)

I was Present at the Conrmittee meeting during the morning of February 9,

L982, at which Representatlve Robie L. Nash made a motion to dlvide hls

two-member dlstricg (couprising all of Rowan County) lnto two single-

member distrlcts. (A copy of the minutes of this meetlng ls attached

hereto as Hale Affidavit //2 Exhlbit B'and is hereby incorporated by

reference as lf fully set forth herein.) At that particular time there

was a tremendous amount of work to be done in a short period of time,

the result of which was that no one realized that the Cormitteers criteria

prohibited this action. The biIl, with Representative Nash's change

ineorporated, was reported favorably to the floor of the House of

Representatives. (e copy of the Committee Substitute for House Bill 1,

adopted 2/9/82, ls attached hereto as Hale Affidavlt il2 Exhibit C/and is

hereby incorporated by reference as if fulLy set forth herein.)

Prlor to the convenlng of the House floor session on Februat! 9, 1982,

this error $ras dl-scovered. The Cornmittee Cochairmen, Representatlves

Robert A. Jones and Danlet- T. Lilley, asked Representatlve Allen Adams

to offer an amendment to restore Rowan County to a two-member district.

I was present during the debate of thls amendment on the House

f1oor. Representative Adams pointed out that under the Comritteers

criteria there rras no reason to divide Rowan County into two dlstricts;

that the relative deviation of the two-member dlstrlct was well under

+ 57"; and the county was not covered by the Voting Rights Act of 1965;

and there was no dilution of uinority voting strength in the two-member

district in violation of the 15th Amendment of the U.S. Constitution.

As a result of this persuasive argument, the :mendment was adopted by

a vote of 77 to 39. (Copies of Amendment No. 1, the House Journal page

reflecting thts floor action, and the House ro11 call- sheet for Amendment

No. 1 are attached hereto as Hale Affidavit /12 Exhibit D/and are hereby

incorporated by reference as if fu1Iy set forth herein.)

Representative fri1]ey, Cochairnan, ca]Ied the neeting

to orcler. A ro11 call was taken, and all members were present.

Representative Li11ey read a paragraph taken from a Jetter

from the U. S. Justice Department to the Executive Secretary

of the State Board of Elections in vrhich our reCistricting

plan was rejectecl. He stated that it would give the Comruittee

sone idca of the gUidelines under which they woulti, need to

operate

Representre'bive Li11ey introduced Jim llallace and. Tiare E.

Smiley, attor:1eys in the Attorney General's office. Repre-

sentativc Lil1ey then recognized Jin lIaLlacer who restated

the two esse:rtiaI consideratj-ons that confront the Committeet

namely (f) that it was incumbent on them to apply the federal

constitutional- one personr one vote requirements set by the

u. s. supreme court in reading the 14th amendment, and

(Z) to ind.icate their advertence to concentrations of minority

t6ters in the bovered counties of the state. He stated' that

She spoke to the Committee and then answered a number of

questions.

Representative Li11ey then asked if there were any

amendments to llouse Bill I before them.

Representative Quinn was recognized. He read. an amencl-

ment affecting Districts 74 and 7) after which he answered.

questions. Representative Li11ey asked Bill llale, an attorney

with the Legislative Services staff, vrhat the amendment did

1'ron the standpoint of deviation, He was advised. that it was

under 9% d.evtation. Representative QUinn moved that the aueacl-

nent be adopted. Representative Grady seconded the notion.

Representative Alnond. spoke against the notion after wbich

Representative Li11ey asked for any other discussion. llhere

being none, he asked for a vote on the amendment set forth by

Representative Quinn.

Representative Hackney sent forth an arqendment with a

copy of a Dap of the townships and districts affected aail

s6conded. Bill ilale advised that neither of the counties

spoke in opposition to the amendment. A vote was taken.

The motion was defeated. Copies of the amendment.and roap

are attached

Representative Nash offered an amendment thaL affected

only Rowan County and moved that it be ad.opted. Bill Hale

advised that the amendment did not affect the overall range.

The notion was seconded by Representative Church. FoLLotring

a brief discussion, a vote was taken, the motion caryied. A

copy of the amendment is attached.

A recess was called' at Il:J) a-tn.

The meeting reconvened at D;2, p.m. at which tine Rep-

resentative Morgan offered an amendment and nap that deaLt

with Guilford County, ancl he noved. for its adoption. The

notion r.ras seconf,ed by Representative Edwards. Mr. Gerry

Cohen explained the amendment further and stated the district

relative deviations were all within >%. There .being no dis-

cussion, a vote was taken, the motion carried.. Cop:-es of the

anendruent and maP are attached.

Representative Gil1an was recognized. and made a notion

that House Bill 1 be given an unfavorable report. A vote

Motion failed.

Representative Taylor offered an amenduent concerning

Districts 12 and 14 and movecl for its adoption. The amenil-

ment would stay within ,% relative deviation and have no

adverse affect on the minority vote in that area. There

tras no discussion. A vote was taken, and the urotion camied.

Representative Spaulding stated. that amend.ments would

be mad.e on the floor of the House Chamber.

Representative Guy noved that House Bill Ir as aroended.,

be given a favorable reportl seconded by Representative Bone..

Representative Ilege was recognized and made a substitute

uotion that House Bill I, as amended, be displaced and that

the single member redistricting plan submitted by hiu last

week be adopted. Represent'ative Hightower made a motion that

Representative llege's substitution motion do 1ie upon the tablet

which he subsequently withdrew. A vote was taken on Represen-

tative l{ege's substitute motion, ani the motion failed.
The original bill was then back before the Coumittee.

A vote r.ras taken on giving House Bill 1r as amondecl, a f avor-

able report. The motion carried
